Terms of Service.

01 — Agreement to Terms
By scheduling, requesting, or accepting any service performed by LOBOS ESTATE SERVICES LLC ("Company," "we," "us"), you ("Client") agree to be bound by these Terms of Service in their entirety. These terms apply to all residential and commercial services including but not limited to lawn maintenance, landscaping, junk removal, estate cleanouts, seasonal decoration installation and removal, and any other property services performed by the Company or its representatives.
These terms constitute a legally binding agreement. Verbal or written service requests — including text messages, phone calls, online form submissions, or in-person agreements — each constitute acceptance of these terms.
02 — Payment Terms & Invoicing
Full payment is due upon completion of services and receipt of digital invoice unless otherwise agreed in writing prior to work commencement. Invoices are delivered via SMS or email to the contact information on file. Accepted payment methods include cash, Zelle, Venmo, CashApp, and major credit/debit cards unless otherwise communicated.
For recurring service agreements, payment is due within 48 hours of each completed service visit. Accounts more than 7 days past due may result in suspension of scheduled services until the balance is resolved. Accounts more than 30 days past due may be referred to collections and may incur a late fee of up to 1.5% of the outstanding balance per month.
Clients on recurring schedules who wish to pause or cancel services must provide a minimum of 5 business days' notice. Failure to provide adequate notice may result in a cancellation fee equal to the standard service rate.
03 — No Refund Policy
All services provided by LOBOS ESTATE SERVICES LLC are strictly non-refundable once work has commenced. This policy applies universally to all service categories regardless of outcome, weather conditions, or client preference changes after work has begun.
In the event of a documented service deficiency directly attributable to Company error, we will re-perform the affected portion of the work at no additional charge. This remedy is the sole and exclusive remedy available to the Client for service-related complaints. Re-performance requests must be submitted in writing within 24 hours of the original service date.
Disputes regarding completed work do not suspend the Client's payment obligation. Payment is required in full before any re-performance or remediation is scheduled.
04 — Liability & Property Conditions
LOBOS ESTATE SERVICES LLC is not liable for damage to unmarked or concealed utilities, irrigation lines, sprinkler heads, invisible fence wiring, buried cables, or similar subsurface infrastructure encountered during lawn maintenance or excavation operations. It is the Client's responsibility to clearly mark or disclose the location of all subsurface utilities and property features prior to service.
The Company is not responsible for property damage resulting from pre-existing conditions, normal wear of aging materials, landscaping features not disclosed at time of service request, or Client-directed removal of items that are later determined to have value. Junk removal and estate cleanout services are performed based on the Client's explicit direction — the Company assumes no liability for items disposed of at the Client's instruction.
Our maximum liability for any claim arising from a single service event shall not exceed the total amount paid by the Client for that specific service, regardless of the nature of the claim.
05 — Scheduling, Access & Service Conditions
Recurring service appointments are scheduled on a biweekly, monthly, or as-needed basis as agreed at time of booking. The Company reserves the right to adjust scheduling due to weather, equipment availability, crew capacity, or force majeure events including but not limited to severe weather, flooding, or road closures. We will make reasonable efforts to notify Clients of rescheduling within a timely manner.
The Client is responsible for ensuring reasonable access to the service area on the scheduled date, including unlocking gates, restraining animals, and removing vehicles or obstacles that would prevent work from being performed. If access is unavailable at the time of the scheduled service, a trip fee may apply at the Company's discretion.
The Company reserves the right to decline or discontinue service to any Client for any reason, including but not limited to unsafe working conditions, persistent access issues, non-payment history, or conduct deemed disrespectful toward Company personnel.
06 — Estimates, Quotes & Scope Changes
All estimates and quotes provided by the Company are based on a visual assessment or description of the work to be performed. Final pricing may be adjusted if conditions at the job site materially differ from what was described or anticipated. Any scope changes discovered during work will be communicated to the Client prior to additional work being performed whenever reasonably practicable.
Quotes are valid for 14 days from the date of issuance. Acceptance of a quote does not constitute a guarantee of scheduling availability. Written confirmation of scheduling is required to reserve a service date.
07 — Photography & Marketing
LOBOS ESTATE SERVICES LLC may photograph before and after conditions of work performed on Client properties for use in marketing materials, social media, website content, and portfolio documentation. Property photography will not include personal identifying information such as visible address numbers, names, or persons without explicit consent. Clients who wish to opt out of photography must notify the Company in writing prior to service commencement.
08 — Governing Law & Disputes
These Terms of Service are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Any dispute arising from services rendered or these terms shall be subject to the exclusive jurisdiction of the courts of Shelby County, Tennessee.
Before initiating any formal legal proceeding, the parties agree to attempt good-faith resolution by contacting the Company directly at info@lobosestateservices.com. The Company will respond to all written complaints within 5 business days.
09 — Modifications to Terms
LOBOS ESTATE SERVICES LLC reserves the right to update or modify these Terms of Service at any time. Updated terms will be posted on our website and will apply to all services rendered after the effective revision date. Continued use of our services following a revision constitutes acceptance of the updated terms. Clients with active recurring service agreements will be notified of material changes via the contact information on file.
